Terms of Service

1. Acceptance of Terms
By accessing or using SafeCrewHQ ("the Service"), operated by SafeCrewHQ ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
SafeCrewHQ is a construction safety management platform that provides Job Hazard Analysis (JHA) creation and dispatch, incident and near-miss reporting, safety audits, training management, worker scheduling, and integration with third-party field service management tools. The Service is delivered via web application and SMS notifications.
3. Account Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription and Billing
The Service is offered on a subscription basis. Pricing, features, and worker seat limits are determined by your selected plan. Subscriptions renew automatically unless canceled before the renewal date. We reserve the right to change pricing with 30 days notice. Refunds are handled on a case-by-case basis.
5. Acceptable Use
You agree to use the Service only for lawful purposes related to workplace safety management. You may not:
- Use the Service to transmit harmful, abusive, or unlawful content
- Attempt to gain unauthorized access to other accounts or systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in a way that could damage, disable, or impair its operation
- Resell or redistribute the Service without our written consent
- Use the API or integrations to exceed reasonable usage limits
6. Your Data
You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service. We will not access your data except as necessary to operate the Service, provide support, or comply with legal obligations.
7. Third-Party Integrations
The Service may integrate with third-party platforms (such as Jobber and other CMMS/FSM tools). These integrations are provided for your convenience. We are not responsible for the availability, accuracy, or policies of third-party services. Your use of third-party integrations is subject to those services' own terms and privacy policies. You may disconnect any integration at any time.
8. SMS Notifications
The Service sends SMS messages to workers for JHA form delivery and safety notifications. By adding worker phone numbers to the platform, the account administrator confirms they have obtained appropriate consent from those workers to receive SMS messages. Standard messaging rates may apply. Workers or administrators can disable SMS delivery at any time.
9. Safety Disclaimer
SafeCrewHQ is a tool to assist with safety documentation and management. The Service does not replace professional safety expertise, regulatory compliance programs, or on-site safety assessments. You are solely responsible for ensuring your workplace safety practices comply with all applicable laws, regulations, and industry standards (including OSHA requirements). We do not guarantee that use of the Service will prevent workplace incidents.
10. Limitation of Liability
To the maximum extent permitted by law, SafeCrewHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless SafeCrewHQ, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.
12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions.
13. Termination
Either party may terminate the subscription at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your access to the Service will cease. We will retain your data for 30 days after termination to allow for export, after which it will be deleted unless retention is required by law.
14. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting a notice on the platform or sending an email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the courts located in Texas.
